The ImpeachMallory.com bloggers have reported that Mayor Mallory and the City of Cincinnati has reinstated the Mayor’s brother Dale as the West End Community Council president.
Admittedly, the crux of their argument seems a bit tenuous, and in need of more investigating:

That listing is dated August 24th. It lists Robert Killins, Jr. as president of the West End Community Council.
The current listing tells a different story. On September 26th, the City’s List has been altered to now list Dale Mallory as President of the West End Community Council. This is news to all of the members of the WECC, who seven months ago voted to remove him from office.
Seems like this could be resolved with a simple letter to the Mayor’s office. I’m sending the following to the attention of Jason Barron, the Mayor’s press liaison:
Dear Mayor Mallory and Mr. Barron:
As you may know, there is a blog dedicated to West End politics entitled “Impeach Mallory.” Today, they are reporting that the City of Cincinnati has reinstated Dale Mallory as the West End Community Council president.
Their evidence is an updated city listing of community council presidents, where Dale’s name has replaced Robert Killens, Jr.
Quite frankly, the article makes it seem like the Mayor is doing something in regards to this alleged re-appiontment.
Is it true that Dale Mallory has become the WECC president again?
Is it true that the Mayor or the City of Cincinnati reinstated him?

Thanks Dean for your coverage on this matter. Your far reaching abilities will help the West End people get the word out that something isn’t right.
From my perspective, things seem to be rather clear. It strongly appears that Community Council bylaws have been tossed out the window, bylaws written by the membership, for the membership & for the well being of the community. I don’t believe any community council bylaws state that the Mayor or anyone else in City government can reinstate or reappoint a council president. That is done solely by those with paid up membership in the respective community.
I’d like to give benefit of the doubt that the listing is a mere typographical misunderstanding, however, what has already come to pass in City Hall leaves me extremely skeptical.
Again, thanks for sending off the letter & your support on airing the issues from all sides.

I guess Nate Livingston is right. Dale is the real WECC President and Killins & Colbert are a bunch of fakers. The West End loves drama. Why would someone replace that name now? What is the reason, how can Dale Mallory benefit from it? This isn’t a mistake or an oversight. This was a deliberate action.

Thanks for the interest.
Do you really think the Mayor would answer our questions?
Last week 4 irate citizens had their 2 minutes in front of the Mayor and Council to blast them regarding EZ issues. They were met with stone cold silence.
There is a CPD investigation on Dale’s theft of WECC funds. Dale’s defense is he is WECC President. This recent ploy uses Mallory power to disort the truth.

It will be interesting to see what the Mayor’s response will be, if anything. I wouldn’t be surprised if you had a hard time getting anyone to respond to your concerns
I think that this is related to the police investigation about the council checks.

Dean,
Dale Mallory was never removed from his position as West End Community Council president, thus there is no need for him to be reinstated. What should happen is that those people who illegally held themselves out to be officers of this community council and used that false pretense to raise money. Those crooks need to be investigated, arrested, indicted, tried, convicted, and sent to jail.

Well, I guess N8 will be taking the Truth Squad to Court next & suing them for whatever false reason he tosses against the wall in an attempt to get it to stick. Another one of those frivolous suits that clog up the court calendar. He goaded the Empowerment Zone to sue the City for money that’s “due” them.

It’s nice to see N8 facing reality here with the EZ & Dale Mallory. N8, it’s being worked on.

It may have been an honest mistake.
The timeing is suspect due to Dale’s “defense” on his criminal charges. My spies say a grand jury will hear the case against Dale in a week or so.
Is this just a coincidence? No one knows for sure.
I sure wouldn’t take the “official story” at face value. Kudos to TS for keeping the bastards on their toes.
Dean, why not ask the Mayor about his real home in Mount Airy? See what kind of “truth” he gives you.

You would have me believe that the WECC would just suddenly start having meetings again with Dale as president because a PDF at the City webpage got uploaded?
That does not make sense. This thing is not a legal document. It is a reference sheet generated by office staff.
No one is protected by such a simple listing.

A minor clerical error in updating an older version was not unexpected.
I personally thought that the impeach dale blog was using this blunder to highlight the fact that obvious evidence of a crime having been comitted and it still has not been addressed.
Thrown together with the fact that the EZ program only has 32% of the funds going to programs & 68% is chewed up in administration, but they still get a pass on continuation of funds.
I find this quite disconcerting that obvious provable crimes and extrodinary wastes of funds are occuring. We can see it. We can prove it. But nothing is done about it. It gets swept under the rug, pushed to the side while “our” government is both unresponsive and unaccountable. They just wait for things to die down.
The Republican congress gave Foley a by and know it is coming back to bite them in the @ss. Do the local Democrats really think that letting this slide won’t bite them in the rear later on?
In a two party system like we have now, I really do feel that the parties must take on the responsibility of clearing out corruption in their midst.
If the people can’t get action on misconduct as blatant as this, what hope do we have of addressing tuffer more complex “white collar” crimes in this city?

Dean makes some great points. It is an office document, not an “official listing”. As far as I know, the city doesn’t maintain “official listings” of community council presidents. This document is about official as it gets. I believe that Nate Livingston has even cited this document in the past in defense of Dale.
That said, just because we are paranoid doesn’t mean that they aren’t out to get us. Nate is claiming again that Dale Mallory is still the WECC president. I do not believe that Dale Mallory has ever admitted that he is no longer the WECC president. He continued to hold meetings and even closed down the WECC bank account months after being removed from office. This isn’t exactly the dead issue / moot point that you play it out to be.
The WECC has never received bank records or any historical information from Dale Mallory. That information is supposed to be transferred by law. Historical records are the property of the West End Community Council, which Dale Mallory is no longer a part of. The only legitimate reason that he would have to keep them is if he still considers himself to be the President of the WECC. We have no idea if Dale is still holding meetings, or still claiming to be West End Community Council President.
The only defense that he can have for spending those funds months after being removed from office is that he was never removed from office. If he admits that he wasn’t President, then closing down the account is an open and shut case.
The police are currently investigating the WECC complaint of criminal embezzlement against Dale Mallory. As that investigation is “reportedly” coming to a close, a City of Cincinnati listing suddenly is altered to list Dale Mallory as the WECC president. The fact that this clerical error is both timely and also supports his criminal defense that he is WECC president was alarming. It was brought to my attention and I blogged about it. Dean’s advice to use more restraint and more research in my blogging is well taken. I am personally not entirely sold that this was just a clerical error, given recent developments. I will grant you that I can’t prove otherwise, and that this does present the most plausible explanation.
We have had some tough luck with City Hall and the authorities. It has been 137 days since Dale Mallory illegally closed down the WECC bank account. You can view the timeline right here. The CPD didn’t want to investigate the complaint, and handed it off to the FBI. The FBI didn’t want to investigate the complaint, and handed it back to the CPD. Meanwhile, the clock keeps ticking.
In late June, members of City Council called for an audit of questionable expenditures of the Cincinnati Empowerment Corporation. Funding was frozen in June. Here we are in October, and funding has been restored without any investigation ever being completed. The last I heard they hadn’t even selected an auditor to look at the concerns addressed by Council.
Given the track record of recent developments, you can expect more than a bit of skepticism from our camp. When the public spotlight is on people pledge to investigate and preach transparency. When that spotlight fades when redirected to other pressing issues things appear to go back as business as usual.
Dale Mallory is a candidate for State Representative in the 32nd District. It will be interesting to see if he can continue to duck the press on these issues. Somebody should ask him if he still considers himself WECC President. If he doesn’t claim to be President, they should ask him when he stopped being WECC President.
Was it in February when he was impeached by over 76% of the West End Community Council?
Was it in April, when the two lawsuits he filed were resolved? One lawsuit was thrown out of court, and the other was dropped by Dale Mallory. When he dropped it he stated he had no intent of remaining WECC President.
Was it in May when he cashed out and closed down the WECC bank account? When did Dale Mallory stop being the President of the WECC? Or as Nate alleges, does he still consider himself President today?
Dale Mallory could clear up the considerable confusion by addressing these issues publicly. He closed down the community’s bank account, and the community deserves answers.

The N8/Mallory camp use the “listings” to support their positions to the CPD and the world.
There is a history here.
The Dale cronies changed the Heberle School meeting notice board of the WECC meeting in March (twice) to undermine the WECC.
The conveniently timed “mistake” may very well have been a meager “defense” plot, or a childish prank to screw with us. or…just an honest mistake.
I bet City Council now regrets their “honest mistake” of the August rules change that now allows a 3M “pocket veto”.
The Mallory Manipulators have their hand in delaying or avoiding Dale’s fenony prosecution. The TS will watch the proceedings and cry foul if they see a cover-up.

I got the same impression. Maybe is was the subliminal posting of Dale’s check a good 10 times at full size. The probably haven’t circulated that image enough, and tried to make up for it in one post.
