Status Report Detailing the Effect of Cincinnati Municipal Code 910-23

Here is the report from City Manager Milton Dohoney to the Mayor and members of Council.  Items of particular interest:  the City has spent more than $41,000 dollars over last year’s amount in defending City ordinance cases (which seems attributable to CMC 910-23); sixty-two guns have been confiscated (but no word on if those guns were unlicensed); 2,010 cases resulting in a 4th degree misdemeanor conviction.

    Over 3000 people have been arrested in one year for having marijuana. 3000 of our neighbors have been made criminals, which will undoubtedly affect their ability to perform in a way that will maximize their contribution to our economy. Besides negatively affecting their economic production, the government will most likely lose cooperation and respect for the oppressive government and consequently less respect for its laws in the future. This contempt will breed more contempt among the individuals acquaintances. And for what purpose?

    Does anyone actually believe that this ordinance will have any positive effect on our society?

    I understand one of the reasons for this ordinance is to give the police a pretext to abuse the constitutional rights of our fellow citizens. So it is about placing the power of government before the individual human rights, which is a good definition of fascism.

    Who are the fascists on city council that voted to pass this ordinance?

    And that report is as poor of a report that I have ever read. It is meaning less because the data given proves nothing. It raises question; it answers nothing, but the idiots on council will not question it for fear of proving how ignorant they are.

    It would appear on the surface that this data indicates the targeting of certain areas and the enforcement of the law selectively. It is curious that noone has had a trial by jury. Most people cop a plea which means the Public Defender becomes a negotiator for the prosecution. How can anybody win in a court that is stacked against you. “Where a man’s paycheck comes from is where his loyalty lies.”

    Judges - paid by the state
    Prosecutors - paid by the state
    witnesses - mostly paid by state or have an interest in the case - plea agreement
    Public Defender - paid by the state
    Then there is you - on your own.

    Can justice be served by this group of state sponsored conspirators.

    At the risk of being called a terrorist (current definition: anyone who disagrees with the government), I think there is a need to overthrow this government. Their arrogant misuse of power was predicted. Just because we have the highest standard of living is no excuse for letting our fellow citizens to abused by the government’s power. At the very least, we need to remove the immunity that government enjoys; afterall it is just another business. And we need to have a legal system that serves the people and not the lawyers and judges that look at themselves as aristocrats, and maintain a self-serving monopoly that few can afford.

    The lack of jury trials is a strong indicator that trial by one’s peers is a myth. Copping pleas is nothing more than government sponsored intimidation and coercion and blackmail.
