Hamilton County Double Standard with Timothy Reed Case

Timothy Reed was arraigned today in Hamilton County Court before Magistrate Amy Searcy at 12:30 p.m. Magistrate Searcy gave Timothy Reed a $500,000 straight bond for child endangerment. Timothy Reed is an African American male, 19 years of age, and father of the infant in question. Mr. Reed says he went asleep and when he woke up, his infant was injured. It is reported that he believes that the other children (toddlers) in the home harmed the child while he was sleeping. The key question is: did he intentionally hurt his child?
The Cincinnati NAACP does not condone harming any children. The issue that the Cincinnati NAACP continues to raise is that there are two criminal justice systems in Hamilton County led by Prosecutor Joe Deters; one for African American citizens and one for white residents.
Mrs. Edwards, a white female, was not charged by Joe Deters and when her baby was found dead (August 2008). Neither was she taken to jail nor was she assessed a bond for any amount. Mrs. Slaby, just got off the Oprah Winfrey Show telling her story about having left her daughter in the SUV who ended dead also (August 2007).
Hamilton County Prosecutor Joe Deters has said that there are no problems--no racial disparities--in Hamilton County’s court system. He claims that the law is being applied equally. Cincinnati NAACP President, Christopher Smitherman, asks, “Can Joe Deters now explain why Mr. Timothy Reed is now sitting in jail under a $500,000 straight bond and Mr. Reed’s baby is NOT dead?”
Smitherman added, “The criminal justice system in Hamilton County is broken. African Americans continue to be extended high, unconstitutional bonds; are over prosecuted; and over-incarcerated in Hamilton County.”
“Timothy Reed has already served more time in jail than both white women,” said Smitherman. This case is scheduled to be heard by Judge Mock on Monday, October 6, 2008 at 9 a.m. Judge Mock is running against Judge Luebbers for a Common Pleas Court judgeship. Joe Deters has endorsed Judge Mock for Common Pleas Judge. Also, Joe Deters is running unopposed per the deal struck by the Democratic Party. President Smitherman continues to urge residents to vote YES on Issue 8 to restore democracy, at a minimum, within the City of Cincinnati.

More details please.
Soon every parent will be in jail.

There are some key questions not answered by Smithermans little narrative.
1) What were the injuries to the child?
2) What condition was Mr Reed in when he went to sleep, as in, was he under the influence of drugs or alcohol?
3) Did the other children in the house have a history of abusing one another?
4) Does Mr Reed have a history of abusive behavior?
5) Why is Slaby, who was not prosecuted by Clermont County, brought up in a complaint about Hamilton County?
6) Is Smitherman delusional enough to think PR, (Issue #8), for City Council races, at a minimum, has anything at all to do with criminal prosecutions by Hamilton County?

That’s not a fair question, well it is, but that question should have been asked of Edwards and Slaby (yes I’m aware the Slaby case was in Clermont County.)
Dirty Deters went on the Lincoln Ware show and stated that he did not require Edwards (nor did anyone else) that she take a drug/alcohol/mental test.
Yet Edwards looked spaced (obviously my opinion) and she sounded loopy on the 911 tape. Here’s the problem. It appears that when one is White, Wealthy, and Well-connected (WWW) the status quo gives such person a pass. It’s not always about race but status and connections.
Hardworking individuals in our group Citizens Against Joe Deters are black, white, hispanic....and all are strongly aware that Hamilton County dishes out a double standard style of justice.

Make A Difference Day is the most encompassing national day of helping others. MADD was created by USA WEEKEND Magazine. It is America’s largest day of doing good. This year Citizens Against Joe Deters will Make A Difference in the lives of Cincinnati citizens by leading a peaceful protest, presenting 500-1,000 collected signatures, and calling for Hamilton County Prosecutor Joe Deters resignation on Friday October 24 (1:00 pm). The Protest will take place at Joe Deter’s office located at 230 E. Ninth Street Cincinnati, Ohio 45202.
Thus far 280 hundred signatures have been collected and 105 randomly selected Cincinnati citizens have been surveyed. They were asked the following 4 questions: Do you feel Joe Deters is a trustworthy Prosecutor? On a scale of 1-10 with 1 being least satisfied, and 10 being most satisfied, how would you rate Joe Deter’s job performance? If there was an opponent running against Joe Deters do you think he would still make divisive comments? If Joe Deters were to resign his position do you think Cincinnati could move forward with change? Overwhelmingly the responses were unfavorable towards Joe Deters.
Citizens against Joe Deters is a grass roots organization of citizens who are frustrated by Hamilton County Prosecutor Joe Deters double standard of justice and public insults against people of color, people who aren’t wealthy, and people who aren’t well-connected. Our organization’s mission is simple--pressure Joe Deters to resign from his position as Hamilton County Prosecutor and as southwest Ohio chair for John McCain’s campaign.
